T&Cs

Preamble
Only the version of the following Terms and Conditions (T&Cs) valid at the time of the order apply to the business relationship between JUCAN x Xhaka AG Stutzstrasse 41, 6005 St. Niklausen (hereinafter “Seller”) and the customer (hereinafter “Buyer”).


Order confirmation
All orders submitted in the online shop are binding. The contract between Buyer and Seller is established by the sending of the order and the electronic acceptance of the T&Cs. By placing an order, you accept our Terms and Conditions as well as all prices and guarantee that you are at least 18 years of age and legally able to conclude binding contracts.

All offers are available “while stocks last”, unless indicated otherwise next to the products. Furthermore, errors are excepted, and we reserve the right to not deliver if the inventory was not correct at the time the order was received. In this case, we will contact you and give you the option of cancelling the order or selecting a different colour/size, depending on availability.


VAT
All prices indicated on the Seller’s website include the statutory VAT applicable in the particular country. There are no other costs for the Buyer. This excludes the shipping costs and any customs duty (see 4. Shipping).


Product availability
If the ordered product is not available because the Seller has not received this product from its supplier through no fault of its own, the Seller may terminate the contract. In this case, the Seller will inform the Buyer without delay and may propose the delivery of a similar product to the Buyer. If no similar product is available, or if the Buyer does not wish to receive a similar product, the Seller will refund the Buyer for any amounts already paid without delay.


The Seller has the right to claim force majeure in the event of war, war-like events, state sanctions, strikes, natural catastrophes or similar. This means that the contract does not have to be fulfilled, either completely or in part. If this is the case, contrary to expectation, an immediate attempt shall be made to contact the Buyer.



Shipping
Shipping within Switzerland is free on orders of CHF 150 or more. Shipping in the EU is free on orders of EUR 150 or more. Shipping costs for orders below these thresholds are CHF 8 or EUR 8, respectively, and will be clearly indicated to the Buyer on a separate information page and as part of the ordering process. All orders will be shipped to the particular recipient country by an authenticated partner within one to two working days.

The supplied products remain the property of the Seller until full payment has been received.


Applicable law
This contract is subject solely to Swiss law. The applicability of the UN Convention on Contracts for the International Sale of Goods is expressly excluded. The contract language is German. The sole place of jurisdiction for any disputes arising from or in connection with these provisions is Lucerne (LU).

Severability clause
Should individual provisions be or become ineffective or invalid, this shall not affect the effectiveness of the remaining provisions. In such cases, the ineffective or invalid provision shall be replaced with a new, legally valid provision, which most closely reflects the economic purpose and impact of the ineffective or invalid provision. The same procedure applies if a contract loophole becomes apparent.
